"I needed a law firm to help me with the legislation of my canadian divorce papers. Since I live in Germany now, I needed to find a trustworthy and professional team to take care of the complicated processes which were required in order to marry in Germany again. Despite Corona and the international laws, the law firm completely took care of everything in the most profesional, time-efficient manner. They completely took the problem out of my hands and I didn't have to worry at all anymore. I absolutely recommended this law firm based on Customer Service, efficiency and price!" - Anja Waschnewski

Trevor Smith is the principal family law attorney at Smith Family Law.
He has been helping spouses and parents navigate family law matters since 2009, bringing over 16 years of dedicated experience to his practice.
After earning his law degree from the University of Victoria in BC, Trevor articled and practiced at large firms in downtown Vancouver. In 2011, he joined a leading Vancouver family law firm, where he spent two years before opening their Toronto office.
In 2016, Trevor founded Smith Family Law to provide clients with the focused attention they deserve, offering compassionate and strategic legal guidance in divorce, custody, and family disputes.
"Trevor has been my family law lawyer since 2012. I originally retained him to initiate divorce proceedings back in 2012, but have kept him as my counsel throughout given his intimate knowledge and background with the scope of my extensive and difficult file.
First and foremost, Trevor has professional integrity and is honest, both to his clients and in court, which is surprisingly not always the case with other lawyers. He provides exceptional counsel to his clients to temper expectations with reality, and is focused on helping to reduce unnecessary conflict and related costs.
Even when Trevor moved from Vancouver to Toronto, I continued to retain him for his services and brought him back out as needed. This illustrates how much confidence I have in him and his value to my case. I would not hesitate to recommend Trevor for your family law needs." - Hank Der

Living in Ontario, I needed somebody with BC credentials to finalize my paperwork.
Trevor was an excellent listener, completed his work in a timely manner, and in my case even though we went a little bit overtime, he stuck to his original quote, and everything went smoothly.
I recommended him to a friend, and she has been very happy with his progress in sad and specific family matter, that up to this point, other lawyers could not achieve Trevor's success.
Dominick Myers.
Trevor Smith Family Law aided me in resolving a custody dispute with the mother of my first child. It was a very difficult time in my life but Trevor made the process straightforward and mitigated the level of stress that dealing with family court can create.
He made himself available to answer any of my questions and concerns and I never felt confused at any time during all the precedings.
While I hope I never have to go through the family court system again. It brings me some comfort knowing that if need be I will have someone that will fight for my best interests.
I would recommend Trevor Smith Family Law to anyone who requires help navigating any family law/court issue.
Trevor Smith and his firm helped guide me through one of life's more emotional times.
He was there each step of the way navigating the legal system to a balanced outcome.
Blair Campbell.
Trevor was an absolute pleasure to work with.
He is always very quick to respond and his level of knowledge and professionalism is unmatched!
Trevor Smith was a truly outstanding lawyer!
He was able to clearly explain every step of the legal process, was compassionate with me during a very difficult time, and never failed to give great advice.
I would hire him again in a minute and would highly recommend him to anyone.
Mike Ford.
So can I give Trevor B Smith a positive review? Yes I can endorse his services unconditionally.
The whole process was painful but that wasn’t because of Trevor that was because of my situation and my reluctance to rectify the problem that existed for years. I was being a chicken and it wasn’t making anybody’s life better. Obviously, the whole endeavor of getting separate then Divorced is traumatic & not the pleasant. It was a decision that took me forever to make and unfortunately one I should’ve made long before. It might have caused less grief for my ex.
But I must admit, Trevor’s assistance, no guidance and friendship that he offered throughout the process was not only beneficial but it was comforting. Not merely because Trevor was on my side defending my interests which he did admirably. Trevor is a good human being and he actually tells you things like they are and he will call a spade a spade.
I am very thankful for that, as well as for his help and tutelage. Would I recommend Trevor B Smith to my friend? YES, wholeheartedly? Five stars all the way.

Ontario courts prioritize the best interests of the child when determining decision-making responsibility and parenting time (formerly custody and access). Factors include:
The child’s emotional and physical needs.
Each parent’s ability to provide a stable environment.
The child’s relationship with each parent and extended family.
Any history of family violence or neglect.
Child support is based on the Federal Child Support Guidelines, which consider:
The paying parent’s gross income.
The number of children.
Additional expenses (e.g., daycare, medical, extracurricular activities).
Even if the other parent is not involved in the child’s life, they are still legally required to pay support.
Yes, grandparents can apply for decision-making responsibility (custody) or contact orders (visitation). The court considers the child’s best interests and whether the grandparents have played a significant role in the child's life.
A parent with decision-making responsibility or parenting time must give at least 60 days’ notice before relocating. If the other parent objects, the court will decide based on factors like:
The reason for the move.
The impact on the child’s relationship with the other parent.
Whether the move improves the child’s well-being.
In Ontario, common-law couples do not have the same property rights as married couples. However:
They may be entitled to spousal support if they lived together for at least 3 years or have a child together.
They do not automatically split property—each person keeps what they own, unless there’s an unjust enrichment claim.
If you are experiencing domestic violence, you can:
Apply for a restraining order through Family Court.
Seek an emergency protection order or exclusive possession of the family home.
Contact local shelters or support services for assistance.
Family law courts take abuse seriously when deciding parenting arrangements.
Spousal support is based on factors such as:
The length of the relationship.
Each person’s financial situation and ability to be self-sufficient.
Whether one spouse sacrificed career opportunities for the relationship.
The Spousal Support Advisory Guidelines (SSAGs) help determine the amount, but courts have discretion in each case.
Yes, adopting a child in Ontario typically requires legal guidance. The adoption process includes:
A home study assessment.
A background check.
Court applications to finalize the adoption.
Whether adopting through a private agency, internationally, or as a step-parent, legal assistance ensures the process follows all legal requirements.
No. A parent cannot deny the other parent access unless there is a court order stating otherwise. If a parent refuses parenting time, the affected parent can:
Apply for an enforcement order.
Request a modification of parenting arrangements if refusal is ongoing.
