"I needed a law firm to help me with the legislation of my canadian divorce papers. Since I live in Germany now, I needed to find a trustworthy and professional team to take care of the complicated processes which were required in order to marry in Germany again. Despite Corona and the international laws, the law firm completely took care of everything in the most profesional, time-efficient manner. They completely took the problem out of my hands and I didn't have to worry at all anymore. I absolutely recommended this law firm based on Customer Service, efficiency and price!" - Anja Waschnewski

Trevor Smith

Trevor Smith is the principal family law attorney at Smith Family Law.

He has been helping spouses and parents navigate family law matters since 2009, bringing over 16 years of dedicated experience to his practice.

After earning his law degree from the University of Victoria in BC, Trevor articled and practiced at large firms in downtown Vancouver. In 2011, he joined a leading Vancouver family law firm, where he spent two years before opening their Toronto office.

In 2016, Trevor founded Smith Family Law to provide clients with the focused attention they deserve, offering compassionate and strategic legal guidance in divorce, custody, and family disputes.

Trusted Advocate & Client-Focused Approach

"Trevor has been my family law lawyer since 2012. I originally retained him to initiate divorce proceedings back in 2012, but have kept him as my counsel throughout given his intimate knowledge and background with the scope of my extensive and difficult file.

First and foremost, Trevor has professional integrity and is honest, both to his clients and in court, which is surprisingly not always the case with other lawyers. He provides exceptional counsel to his clients to temper expectations with reality, and is focused on helping to reduce unnecessary conflict and related costs.

Even when Trevor moved from Vancouver to Toronto, I continued to retain him for his services and brought him back out as needed. This illustrates how much confidence I have in him and his value to my case. I would not hesitate to recommend Trevor for your family law needs." - Hank Der

Will Watson

Living in Ontario, I needed somebody with BC credentials to finalize my paperwork.

Trevor was an excellent listener, completed his work in a timely manner, and in my case even though we went a little bit overtime, he stuck to his original quote, and everything went smoothly.

I recommended him to a friend, and she has been very happy with his progress in sad and specific family matter, that up to this point, other lawyers could not achieve Trevor's success.

Trevor Smith Family Law aided me in resolving a custody dispute with the mother of my first child. It was a very difficult time in my life but Trevor made the process straightforward and mitigated the level of stress that dealing with family court can create.

He made himself available to answer any of my questions and concerns and I never felt confused at any time during all the precedings.

While I hope I never have to go through the family court system again. It brings me some comfort knowing that if need be I will have someone that will fight for my best interests.

I would recommend Trevor Smith Family Law to anyone who requires help navigating any family law/court issue.

So can I give Trevor B Smith a positive review? Yes I can endorse his services unconditionally.

The whole process was painful but that wasn’t because of Trevor that was because of my situation and my reluctance to rectify the problem that existed for years. I was being a chicken and it wasn’t making anybody’s life better. Obviously, the whole endeavor of getting separate then Divorced is traumatic & not the pleasant. It was a decision that took me forever to make and unfortunately one I should’ve made long before. It might have caused less grief for my ex.

But I must admit, Trevor’s assistance, no guidance and friendship that he offered throughout the process was not only beneficial but it was comforting. Not merely because Trevor was on my side defending my interests which he did admirably. Trevor is a good human being and he actually tells you things like they are and he will call a spade a spade.

I am very thankful for that, as well as for his help and tutelage. Would I recommend Trevor B Smith to my friend? YES, wholeheartedly? Five stars all the way.

Frequently Asked Questions

How is child custody determined in Ontario?

Child custody is decided based on the best interests of the child. The court considers factors such as the child’s relationship with each parent, their routine, stability, and each parent’s ability to meet their needs. Ontario has moved away from the term "custody" and now uses decision-making responsibility and parenting time to define parental rights and responsibilities.

How is child support calculated?

Child support is based on the Federal Child Support Guidelines, which consider the paying parent's income and the number of children. Additional expenses like daycare, medical costs, and extracurricular activities may also be shared between parents.

What are my rights in a divorce in Ontario?

Both spouses have rights regarding property division, child custody, child support, and spousal support. Ontario follows equal division of net family property, meaning marital assets and debts acquired during the marriage are typically split equally, but there are exceptions.

How long does the divorce process take in Ontario?

An uncontested divorce can take as little as 4-6 months, while a contested divorce—involving disputes over assets, support, or custody—can take a year or more, depending on court availability and complexity.

Do I have to go to court for a divorce or family law dispute?

Not necessarily. Many family law matters are resolved through mediation, arbitration, or negotiation without court involvement. However, if agreements can’t be reached, court intervention may be necessary.

How is property divided in a divorce?

Ontario follows the equalization of net family property rule, meaning that any increase in assets during the marriage is typically split 50/50. However, assets like inheritances, gifts, and pre-marital property may be excluded in certain cases.

Am I entitled to spousal support?

Spousal support depends on factors such as the length of the marriage, each spouse’s income and financial needs, and whether one spouse sacrificed career opportunities for the marriage. The Spousal Support Advisory Guidelines help determine amounts, but each case is unique.

What happens if my ex doesn’t pay child or spousal support?

Support orders in Ontario are enforced by the Family Responsibility Office (FRO). If a parent fails to pay, FRO can take actions like garnishing wages, suspending driver’s licenses, or seizing assets.

Can I relocate with my child after separation?

If you have decision-making responsibility or parenting time, you may need court approval or the other parent’s consent before relocating. The court will assess whether the move is in the child’s best interests, considering their relationship with both parents.
